Öz

This article examines the integration of artificial intelligence technologies into public administration within the context of Turkey from constitutional and public law perspectives. The use of AI in public institutions should be regarded not merely as a technical advancement but as a structural transformation concerning democratic governance, fundamental rights, and legal accountability. The article evaluates the tense relationship between algorithmic decision-making systems and the principles of the rule of law through concepts such as legality, transparency, accountability, and the prohibition of discrimination. Existing legal gaps in Turkey are analyzed in comparison with the European Union’s Artificial Intelligence Act (AI Act), and the potential impacts of international trends on Turkey are discussed. The study argues for guiding technological progress in alignment with constitutional values and the principle of public interest, emphasizing the need for a social justice-based, participatory, and democratic regulatory model. In conclusion, it proposes an ethical, inclusive, and holistic legal governance approach to ensure equal access to public services and prevent algorithmic inequalities.
